Experts pointed out the significant interference by the executive branch in the Justice system
The public discussion of the Draft Law № 1008 on “Amendments to certain laws of Ukraine concerning the operation of Judicial Governing bodies” with stakeholders, experts and publicity took place on September 7, 2019.
The Member of the High Council of Justice, the Member of the First Disciplinary Chamber at the High Council of Justice Igor Fomin pointed at the problems of lack of independence of the Judicial power: “At first, the situation when both the legislative and executive branches of power interfere in its operation is inadmissible. Secondly, the independence of the court is based, first of all, on inability to dismiss the judge. The Draft Law offers the contrary – to dismiss the half of the Judges of the High Court”.
Besides, as Igor Fomin pointed out, the procedure and motivation of such lay off is unclear. Additionally, he emphasized the necessity to keep the courts financially independent.
