Oksana Dytynko delivered a report on Criminal proceedings in absentia in Ukraine

The attorney shared useful advice and characteristics of special strategies of clients’ defense, against whom the criminal proceedings in absentia were initiated, with the audience using real cases of the company and her own experience.
Ms. Dytynko pointed out that the provision on criminal proceedings in absentia differs greatly from the practice in the European countries, where such procedure is possible only concerning minor crimes with obligatory presence of the defense. The speaker drew attention that current provisions in Ukraine violate substantially the fundamental right of the person for defense. Therefore, the attorney came to the conclusion that the institute of criminal proceedings in absentia is in need of changes in order to provide the principle of adversarial process and the justice.
